GENERAL TERMS AND CONDITIONS
IH&SAT UG (haftungsbeschränkt) is a personal development organisation, whose head office is at Stadtstrasse
11, D- 79104 Freiburg, (Germany). IH&SAT UG develops, offers and delivers in-person, distance and online mode (live or recorded) courses as well as hybrid training courses combining both in-person and online formats.
These general terms and conditions (hereinafter referred to as the “GTC”) apply to all courses and events organised by IH&SAT UG.
- CONCLUSION OF THE CONTRACT: Registration can be made in writing or online via the IH&SAT UG website. When an application is done online, the sender receives a copy of his/her registration data and an individual confirmation link at the e-mail address provided. The participant´s registration does not yet constitute the conclusion of a contract. The contract shall only be concluded upon written confirmation of the registration by IH&SAT UG.
- EXECUTION OF THE CONTRACT: The contract will be performed by holding the course. IH&SAT UG reserves the right to cancel events up to 14 days before the scheduled date if the minimum number of participants is not reached. If the event is cancelled for this reason or – even later – due to justified absence of the course facilitator, force majeure, official directives or other unforeseeable events for which IH&SAT is not responsible, IH&SAT UG shall not be obliged to maintain the event. It undertakes to inform the participants immediately in writing. If the course facilitator is unable to attend, IH&SAT UG reserves the right to substitute with a facilitator of equal value. In this case, there is no right to reimbursement of the participation fee.
- CANCELLATION: In the event of cancellation of the event, the IH&SAT UG will attempt to re-register the participant for another course date, provided that the participant agrees to this. Otherwise, the seminar fee already paid will be refunded in full. If a cancellation occurs during the course for any of the above reasons, only a pro rata refund will be made. Any further claims by the participant, in particular claims for damages of any kind which do not concern injury to life, body or health, are excluded, except in the case of intentional or grossly negligent behaviour by employees or members of IH&SAT UG’s team. This also applies to vain expenses (e.g. for booked hotel rooms, flight or train tickets). In all other respects, the provisions of the ‘Liability’ section shall apply.
- CONTENT OF THE COURSE: The content and execution of the respective course is governed by the respective course programme which forms an integral part of this contract. IH&SAT UG reserves the right to modify the content of certain courses for technical reasons without the agreement of the participant if this does not affect the core of the agreed course.
- LIMITATION OF LIABILITY: The following limitations of liability do not apply to damage caused by gross negligence, wilful misconduct or loss of life, physical injury or impairment to health. IH&SAT UG shall only be liable for other damages if they are based on intentional acts or grossly negligent acts or on the culpable breach of an essential contractual obligation by IH&SAT UG and/or members of its team. Any further liability for damages is excluded, including liability for damages of any kind due to a participant´s failure to observe or follow the basic ground rules, to the extent permitted by law. Pre-contractual liability is not applicable. IH&SAT UG is not liable for damage caused by accidents and/or the loss or theft of objects brought into the working rooms/course premises, in particular cloakroom items or valuable objects.
- RESPONSIBILITY AND AUTONOMY OF THE COURSE PARTICIPANT: By registering, each participant affirms that he/she assumes full responsibility for his/her actions. He/she agrees to provide truthful information about any physical or psychological problems prior to the event. If the participant is undergoing medical or psychotherapeutic treatment, we reserve the right to request the consent of the practitioner to participate in the desired course. We reserve the right to exclude participants from further participation in justified cases and in accordance with the basic therapeutic ground rules, in which case the participation fee will not be refunded.
- PAYMENT AND CANCELLATION TERMS: The course fee includes all services described in the offer or in the course registration confirmation. When registering for a course, a reservation fee of the amount indicated on the website is due. IH&SAT UG will then, where appropriate, approve the registration. At this stage, the reservation fee becomes a deposit of the course fee. The remaining amount is due no later than 4 weeks before the start of the course. However, in case of use of the reduced fee for early reservation, the full amount is due immediately upon confirmation of the registration by IH&SAT UG. With the enrolment and/or transfer less than 14 days before the start of the course and the appearance at the start of the course, the participant agrees that the service of IH&SAT UG should already begin during the cancellation period (see cancellation policy). No reservation fee is charged for online courses. After confirmation of registration by IH&SAT UG, the full participation fee is due. For in-person and hybrid courses payment in instalments and postponement of the participation to a later date are possible with an additional processing fee of €70.
- CANCELLATION: Cancellation of the contract is possible at any time in text form. To meet the deadline, the cancellation notice must be received by IH&SAT UG in writing by post, fax or e-mail. If the participant withdraws from the course after the confirmation of registration and the expiry of the withdrawal period, the IH&SAT UG will refund the deposit by applying a deduction of €70 for file processing costs up to 4 weeks before the start of the course. From 4 weeks before the start of the course, 50% of the participation fee will be charged, from one week before the start of the course 100% of the participation fee will be charged. If the participant does not attend the event, the full participation fee will be charged. For online courses, cancellations can be made free of charge up to 2 weeks before the event date. In the event of later cancellation, the full price will be charged.
- INTELLECTUAL PROPERTY: All working documents issued are protected by copyright. They are made availableexclusively to the participants of a course. IH&SAT UG reserves all rights, including translation, reprinting and reproduction of the documents or parts thereof. All documents, including extracts, may not be reproduced, processed, copied, distributed, or used for public reproduction in any form without the written permission of IH&SAT UG.
- CONFIDENTIALITY: The participant expressly undertakes to respect the confidentiality of the personal data and the experiences of the other participants on the course. During a course, no photographs or video or audio recordings may be taken and published in any way whatsoever without the express consent of IH&SAT UG and the participants concerned. The use of participant contacts details in any way whatsoever without the express consent of IH&SAT UG and the persons concerned is prohibited.
- ADDITIONAL COSTS: The registration fees indicated for in-person courses cover the net costs of the course, accommodation and catering costs are not included in IH&SAT UG’s offer. If participation in the course involves accommodation and catering, the course participant must pay for this himself/herself.
- RESERVATION OF ACCOMMODATION AND CATERING: Courses take place in different course centres. With the conclusion of the course contract, the participant entrusts IH&SAT UG with the reservation of accommodation in his/her name and on his/her behalf. IH&SAT UG forwards the accommodation request to the course centre and endeavours to meet the accommodation request of the participants but does not guarantee the first choice. The allocation of single rooms has priority for participants who pay the full seminar fees (without reduction for students or job seekers). The participant pays the invoice for accommodation and meals directly to the course centre concerned. In the event of withdrawal or early departure, the participant is responsible for the cancellation costs.
- FINAL PROVISIONS: These conditions of participation contain all the rights and obligations of the contracting parties. If the participant is a retailer or does not have residence in the European Union, the registered office of IH&SAT UG shall be the sole place of jurisdiction for all disputes between the contracting parties, including actions on bills of exchange and checks. German law shall apply exclusively to the exclusion of the provisions of the United Nations Convention on Contracts for the International Sale of Goods. In dealings with end customers within the European Union, the law of the place of residence of the end customer may also apply, provided that the mandatory provisions of consumer law are concerned. If one of these provisions is invalid, this shall not affect the validity of the other provisions. In the event of a dispute arising between the participant and IH&SAT UG, an amicable solution will be sought.
